Indecent Exposure Attorney in Birmingham

More Than 70 Years of Combined Experience Behind Your Defense

An indecent exposure accusation can threaten your employment, family relationships, reputation, and future opportunities. It isn’t a conviction. Alabama prosecutors must prove specific facts about the alleged exposure, what you knew about the circumstances, and whether you acted with the required sexual intent.

We examine those elements against the evidence rather than treating the accusation as established fact. Prompt review also allows us to assess charging documents, police reports, witness accounts, recordings, messages, and upcoming deadlines.

What Alabama Must Prove for an Indecent Exposure Conviction

Alabama Code § 13A-6-68 defines indecent exposure as exposing the genitals with the intent to arouse or gratify sexual desire under circumstances the person knows are likely to cause affront or alarm. Nudity or exposure alone doesn’t necessarily establish every element of the offense.

For a conviction, the State must prove each required element beyond a reasonable doubt:

  • Exposure: The accused exposed the genitals.
  • Knowledge: The accused knew the circumstances were likely to cause affront or alarm.
  • Sexual intent: The accused intended to arouse or gratify sexual desire.

If the evidence fails to establish any required element beyond a reasonable doubt, the jury instruction for this offense directs that there can’t be a conviction.

Charge Classification & Registration Duties Under Alabama Law

Indecent exposure is generally a Class A misdemeanor in Alabama. Under Alabama Code § 13A-6-68, a third or subsequent conviction is a Class C felony. The offense can also be charged as a Class C felony when the alleged victim is under 12. Classification therefore depends on the allegations and the person’s conviction history.

A first conviction can involve sex offender registration and verification, including duties to register and periodically confirm required information. Although a person may not appear on Alabama’s public sex offender registry solely because of a first conviction for this offense, registration obligations can still apply. The precise requirements depend on the conviction, prior record, case facts, and version of Alabama law in effect.

Which Court Handles a Charge Filed in Birmingham?

Birmingham Municipal Court handles misdemeanor criminal cases arising within the city’s limits and police jurisdiction, but not every Birmingham-area allegation follows the same path. The alleged location, filed charge, and issuing authority can determine which court has jurisdiction.

The citation, warrant, bond paperwork, or court notice may identify important deadlines and appearance requirements. We review those documents to determine the court, examine the charging language, and explain the next procedural step.

Evidence That Can Shape an Indecent Exposure Defense

A criminal defense strategy must come from the evidence, not a generic list of arguments. Depending on the allegation, relevant issues may include accidental conduct, lack of sexual intent, lack of knowledge that the circumstances were likely to cause affront or alarm, mistaken identity, unreliable identification, or insufficient proof.

Our evidence review may address:

  • Setting and visibility: Where the alleged conduct occurred, who could observe it, and the surrounding physical conditions.
  • Witness accounts: What each person claims to have seen and whether the accounts are consistent.
  • Digital evidence: Available recordings, photographs, messages, location information, and other electronic material.
  • Police evidence: Officer observations, reports, body-camera footage, and statements attributed to the accused.

Evidence can carry different significance for each element of the charge. We compare every factual claim with the statutory requirements and assess whether the State’s evidence establishes exposure, knowledge, and sexual intent.

Criminal Defense Since 2010 for Clients Across Alabama

We’ve practiced criminal defense since 2010, representing clients in negotiations and court proceedings throughout Alabama. Our practice includes sex crimes, and our lawyers bring more than 70 years of combined attorney experience to criminal allegations and procedural questions.

Negotiation and trial preparation aren’t competing approaches. Based on the evidence, legal issues, and your circumstances, we assess the advantages and disadvantages of plea discussions, available alternative programs, and preparing for trial. No result can be predicted from the charge alone.

What to Expect During Your Initial Consultation

We’ll ask about the circumstances, review paperwork from law enforcement or the court, and identify known deadlines. Bring any citation, warrant, bond documents, and court notices available. Until you receive legal advice tailored to your situation, avoid discussing the allegation with investigators, witnesses, employers, or others who may become involved in the case.

If we represent you, we’ll keep you informed about discovery, potential defenses, plea offers, and court preparation as the case develops.
